Paid subscriptions renew automatically at the billing interval shown at checkout unless canceled before the renewal date. You can cancel future renewals through the available account or billing controls. Our standard voluntary refund eligibility requires a request within 24 hours after payment and total service usage associated with that purchase to be fewer than 40 credits, subject to the full Refund Policy and any non-waivable rights under applicable law.
1. Acceptance of these Terms
These Terms of Service (“Terms”) form a binding agreement between you and Cloudvale LLC (“Cloudvale,” “AIto3D.ai,” “we,” “us,” or “our”). By accessing or using AIto3D.ai, creating an account, purchasing a plan or credits, uploading content, generating or downloading a 3D model, or otherwise using any part of the Service, you agree to these Terms and our incorporated policies.
If you do not agree, do not access or use the Service. If you use the Service for a company, studio, school, organization, or other legal entity, you represent that you have authority to bind that entity, and “you” includes that entity.
2. The AIto3D.ai Service
AIto3D.ai provides browser-based and cloud-based tools for creating, processing, previewing, transforming, measuring, rendering, and downloading 3D content. Features may include:
- Generating 3D models from text prompts, a single image, or multiple reference images.
- Optional geometry, texture, material, mesh, quality, or model settings.
- Interactive previews and downloads in supported formats such as GLB, OBJ, FBX, STL, PLY, USDZ, or 3MF.
- 3D file conversion, GLB compression, volume and dimension calculations, image rendering, turntable video, and other utilities.
- Free, trial, subscription, and credit-based access, as displayed on the Service or pricing page.
Specific features, models, formats, credit costs, generation limits, processing times, availability, and plan entitlements may change. The current product interface and pricing page control when they conflict with a general description in these Terms.
3. Eligibility, accounts, and security
You must be at least 18 years old, or the legal age of majority where you live, to create a paid account or enter into these Terms. The Service is not directed to children.
You must provide accurate account and billing information, keep your credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account unless applicable law provides otherwise. You may not sell, transfer, share for commercial pooling, or rent an account or subscription without our written permission.
4. Prompts, images, files, and other inputs
“Inputs” include text prompts, images, photographs, illustrations, sketches, reference views, 3D files, textures, materials, metadata, and other content you submit to the Service.
You retain any rights you lawfully hold in your Inputs. You grant Cloudvale and its service providers a worldwide, non-exclusive, limited license to host, copy, transmit, modify, convert, analyze, and process Inputs only as reasonably necessary to operate, secure, improve, support, and provide the Service, comply with law, and enforce these Terms, subject to our Privacy Policy.
You represent and warrant that you have all rights, permissions, licenses, and lawful bases needed to submit and process your Inputs. Do not upload content that infringes copyright, trademark, patent, privacy, publicity, confidentiality, contractual, or other rights.
5. AI-generated and processed outputs
“Outputs” include generated 3D geometry, meshes, textures, materials, renders, previews, converted files, compressed files, measurements, videos, and other results produced through the Service.
AI and automated 3D processing are probabilistic. Outputs may be inaccurate, incomplete, distorted, non-manifold, non-watertight, incorrectly scaled, visually inconsistent, unsuitable for rigging or animation, or similar to outputs provided to other users. We do not promise that an Output is unique, copyrightable, registrable, non-infringing, production-ready, printable, structurally sound, or suitable for any particular purpose.
You must review every Output before relying on, publishing, manufacturing, printing, selling, distributing, or incorporating it into another product or project. You are responsible for determining whether your use is lawful and whether additional permissions, testing, editing, retopology, UV work, material correction, scale calibration, engineering review, or safety validation is required.
6. Ownership and platform licenses
Your Outputs
As between you and Cloudvale, and to the extent permitted by applicable law, Cloudvale does not claim ownership of eligible Outputs created for you through the Service, excluding our software, interfaces, templates, branding, documentation, pre-existing materials, and third-party materials. Your rights remain subject to these Terms, your plan, the Commercial License, the rights in your Inputs, and applicable law.
AIto3D.ai materials
The Service, including its software, visual design, source code, models, workflows, documentation, logos, trademarks, and site content, is owned by or licensed to Cloudvale and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service in accordance with your plan and these Terms.
No exclusivity or rights clearance
Outputs are not exclusive. Similar or identical content may be generated for other users. A download, commercial certificate, or paid plan does not mean that Cloudvale has cleared your Input or Output against third-party intellectual property, publicity, privacy, design, product safety, or other rights.
7. Commercial use and license certificates
All eligible paid subscription users are provided commercial-use rights for eligible Outputs under the AIto3D.ai Commercial License and may download a commercial license certificate where that feature is available.
The Commercial License page controls the scope, conditions, exclusions, and limitations of commercial use. A certificate confirms the account and plan information recorded by AIto3D.ai; it does not certify that your Input was lawfully sourced, that the Output is unique, that intellectual property rights exist in the Output, or that third-party rights have been cleared.
Free or trial access does not include a commercial license certificate unless the applicable plan or product page expressly states otherwise.
8. Acceptable use and prohibited conduct
You may not use the Service to create, upload, process, distribute, or facilitate content or activity that:
- Violates law, sanctions, export controls, court orders, or the rights of another person.
- Infringes intellectual property, privacy, publicity, confidentiality, or contractual rights.
- Sexualizes or exploits minors, depicts non-consensual sexual content, or facilitates abuse or trafficking.
- Contains or depicts adult, NSFW, pornographic, sexual, or sexually explicit content, including consensual adult content, sexual acts, sexualized nudity, fetish content, or sexualized characters, whether submitted as an Input or generated, uploaded, processed, rendered, previewed, or distributed as a 3D model or related media.
- Promotes terrorism, violent extremism, targeted hate, credible threats, harassment, or unlawful discrimination.
- Facilitates construction of illegal weapons, regulated contraband, dangerous devices, or other unlawful goods.
- Impersonates another person, creates deceptive identity or endorsement claims, or enables fraud or misleading commercial practices.
- Contains malware, malicious code, credential theft, unauthorized surveillance, or instructions to compromise systems.
- Attempts to bypass security, moderation, access controls, rate limits, plan limits, payment controls, or credit accounting.
- Uses automated scraping, excessive requests, resale, account sharing, or other activity that burdens or disrupts the Service.
Adult and NSFW content is strictly prohibited on the Service, including content involving consenting adults. We may block or remove prohibited Inputs and Outputs and may suspend or terminate accounts that attempt to generate, upload, process, render, or distribute such content.
We may use automated and human review, technical controls, rate limits, and third-party moderation services to detect or prevent abuse. We may reject Inputs or Outputs without completing a generation when reasonably necessary for safety, legal, or payment-network compliance.
9. Credits and usage
Credits are limited, non-transferable digital units used to access eligible Service functions. Credits are not money, stored value, a bank account, cryptocurrency, or a property interest; they have no cash value and may not be sold, transferred, or redeemed except where required by law.
Credit charges depend on the selected model, geometry, texture, material, mesh, output, quality, or utility settings shown before generation. Subscription credits may renew, reset, or expire according to the plan displayed at purchase. Promotional or free credits may have separate restrictions or expiration dates.
When our system confirms that a generation failed and no usable Output was created, the credits charged for that failed operation may be returned automatically according to the Service’s technical records. A result that requires editing, has aesthetic issues, or differs from your expectations is not necessarily a technical failure.
10. Paid subscriptions, renewal, and cancellation
When you purchase a recurring plan, you authorize the applicable payment provider or merchant of record to charge the displayed subscription price, applicable taxes, and any clearly disclosed fees at the interval selected at checkout.
Automatic renewal: Your subscription renews automatically until canceled. The renewal amount and interval are shown at checkout and may also appear in your account, receipt, or billing portal.
You may cancel future renewal through the account or billing-management method made available to you, or by contacting us. Cancellation stops future recurring charges but normally does not retroactively reverse a completed payment. Unless a refund is issued or the Service states otherwise, access generally continues until the end of the paid billing period.
Plan upgrades, downgrades, prorations, credit changes, and effective dates are handled as shown in the checkout or account interface. We will provide notice of material price changes when required by applicable law.
11. Refund policy
Our standard voluntary refund eligibility requires both of the following:
- The refund request is submitted within 24 hours after the relevant payment; and
- Total Service usage associated with that purchase is fewer than 40 credits.
Full eligibility rules, exclusions, request instructions, and processing information are available in the AIto3D.ai Refund Policy, which is incorporated into these Terms.
Unless required by law or expressly stated in the Refund Policy, refunds are not guaranteed after the time or usage threshold has been exceeded, for unused or expired credits, for dissatisfaction with a non-defective AI result, or for a renewal that was not canceled before billing.
Please contact us before initiating a payment dispute so we can investigate the transaction. Fraudulent or abusive chargebacks may result in account suspension and recovery of amounts lawfully owed.
12. Mandatory consumer rights
Nothing in these Terms limits rights that cannot lawfully be waived. If you are a consumer in the European Union, European Economic Area, United Kingdom, or another jurisdiction with mandatory digital-service protections, those protections continue to apply.
Depending on your location and the legal classification of the purchased service or digital content, you may have a statutory withdrawal or cancellation period. When permitted by law, if you expressly request immediate performance, begin using credits, start a generation, or download digital content before that period ends, your withdrawal right may be reduced or lost after performance begins or digital content is supplied. Any checkout acknowledgment will apply only to the extent permitted by law.
Our 24-hour and fewer-than-40-credits refund policy is a contractual refund policy and does not replace any separate remedy you are entitled to under mandatory law for non-conforming, defective, or misdescribed digital services.
13. Payments, merchant of record, and taxes
Payments may be processed by an authorized payment processor or merchant of record. The entity identified at checkout or on your receipt may collect payment, calculate and remit applicable sales tax, VAT, GST, or similar taxes, issue invoices, administer payment methods, and handle transaction-level compliance. Your payment transaction may also be subject to that provider’s terms and privacy notice.
You are responsible for providing accurate billing information and for any taxes or charges that are not collected at checkout. Prices may be displayed in different currencies and can vary by plan, region, tax treatment, promotional eligibility, or billing interval, as permitted by law.
14. 3D printing, engineering, and production responsibility
AIto3D.ai is a creative and productivity tool, not an engineering, architectural, medical, manufacturing, product-safety, or regulatory certification service. Measurements, volume estimates, dimensions, topology, materials, physical clearances, wall thickness, tolerances, center of gravity, load capacity, watertightness, manifold status, and printability may be inaccurate.
Before physical production or deployment, you must independently inspect and test the Output using appropriate professional software, qualified personnel, prototypes, and safety procedures. Do not rely on an Output for structural, medical, safety-critical, weapon, transportation, industrial, or regulated use without qualified review and all required approvals.
15. Service availability and changes
We may add, modify, limit, suspend, or discontinue features, models, formats, integrations, or plan entitlements. We do not guarantee uninterrupted operation, permanent storage, a specific generation time, compatibility with every browser or 3D application, or continued availability of any particular AI model.
You should download and maintain backups of important Outputs. We may impose file-size, storage, retention, rate, or usage limits and may delete temporary uploads or generated files according to our operational and privacy practices.
16. Privacy and data processing
Our collection and use of personal information is described in the AIto3D.ai Privacy Policy. You must not submit another person’s personal information, biometric data, confidential information, or private images unless you have a lawful basis and all required permissions.
17. Copyright and rights complaints
If you believe content processed or made available through AIto3D.ai infringes your rights, send a notice containing: your contact details; identification of the protected work or right; identification and location of the disputed content; a good-faith statement; a statement that the information is accurate and that you are authorized to act; and your physical or electronic signature.
Send notices to [email protected] or through our online contact form. We may remove or restrict content, request additional information, notify the affected user, and terminate repeat infringers where appropriate.
18. Suspension and termination
You may stop using the Service at any time. We may suspend, restrict, or terminate access when we reasonably believe you violated these Terms, created legal or security risk, failed to pay, abused credits or refund systems, caused chargebacks, infringed rights, or used the Service in a manner prohibited by payment networks or law.
Upon termination, your right to access the Service ends. Provisions that by their nature should survive—including ownership, licenses already granted, payment obligations, disclaimers, limitations of liability, indemnity, and dispute terms—will survive.
19. Disclaimers
To the maximum extent permitted by law, the Service and all Outputs are provided “as is” and “as available.” Cloudvale disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uniqueness, availability, and compatibility.
We do not warrant that the Service will be error-free, secure, uninterrupted, or free of harmful components; that any Input will produce a usable Output; or that an Output will meet artistic, technical, legal, commercial, manufacturing, printing, or platform requirements.
20. Limitation of liability
To the maximum extent permitted by law, Cloudvale and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, goodwill, business opportunity, or production; replacement costs; or damages arising from Inputs, Outputs, account compromise, service interruption, third-party claims, manufacturing, printing, or reliance on generated content.
To the maximum extent permitted by law, the aggregate liability of Cloudvale for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid to Cloudvale or its authorized seller for the Service during the 12 months before the event giving rise to the claim, or (b) US $100.
Some jurisdictions do not allow certain exclusions or limits. In those jurisdictions, these limits apply only to the fullest extent permitted by law.
21. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless Cloudvale and its affiliates, officers, employees, contractors, licensors, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your Inputs, Outputs, products, commercial use, violation of these Terms, infringement of third-party rights, or unlawful use of the Service. This section does not apply to consumers where prohibited by mandatory law.
22. Governing law and disputes
Before filing a formal claim, you agree to contact us and provide a reasonable opportunity to resolve the issue. We will likewise try to resolve disputes in good faith.
Except where mandatory consumer law provides otherwise, these Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Subject to any non-waivable right to bring a claim elsewhere, the state and federal courts located in Wyoming will have exclusive jurisdiction over disputes arising from these Terms or the Service.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
23. Changes to these Terms
We may update these Terms to reflect changes to the Service, business, law, safety practices, or payment requirements. The revised Terms will be posted on this page with a new “Last updated” date. When required by law, we will provide additional notice or request renewed consent.
Your continued use after revised Terms take effect means you accept them, except where applicable law requires another form of consent.
